Terms of Service

These terms describe the agreement between your organization and Unclara OÜ, a company registered in Estonia and the provider of the Unclara platform. Using the service means you accept them.

This is a plain-English starter document provided for transparency. It is not legal advice and does not claim certification or guaranteed regulatory compliance.

1. Accounts

You must provide accurate information, keep credentials secure and are responsible for activity in your workspace. Workspace administrators control who has access.

2. Subscriptions and trials

Paid plans are billed monthly or annually in advance. Trials run for 14 days and do not require a card. If you do not subscribe at the end of a trial, the workspace becomes read-only before deletion. Fees are non-refundable except where required by law, and you can cancel at any time with effect from the end of the current billing period.

3. Uploaded learning materials

You keep ownership of everything you upload. You grant Unclara OÜ a limited licence to store and process that content solely to provide the service. You confirm you have the rights needed to upload it and that it does not infringe third-party rights.

4. Learner data responsibilities

You decide which learner data enters the platform and are responsible for informing learners and obtaining any consent required in your jurisdiction. Unclara OÜ processes that data on your instructions.

5. AI output

Generated questions, mastery estimates and recommendations are probabilistic and may contain errors. They are decision support, not decisions. Do not use them as the sole basis for grading, certification or any consequential judgement about a person.

6. Acceptable use

Do not misuse the platform: no unlawful content, no attempts to breach security or rate limits, no reverse engineering, no reselling the service without agreement, and no upload of sensitive personal data beyond what the service is designed to handle.

7. Availability

We work to keep the service available and may perform maintenance. We do not guarantee uninterrupted availability unless a separate service-level agreement is in place.

8. Suspension and termination

We may suspend or terminate access for non-payment or serious breach of these terms, with notice where practical. You may close your workspace at any time and export your data before doing so.

9. Liability

The service is provided on an "as is" basis to the extent permitted by law. Our aggregate liability is limited to the fees you paid in the twelve months before the claim. Nothing here limits liability that cannot be limited by law.
